Terms and Conditions of Services

These Terms and Conditions govern the use of services provided by Estudio Bohora, including the purchase of pre-designed website templates and custom web design projects. By purchasing a product or engaging in a service agreement with Estudio Bohora, you agree to the following terms:

1. Services Provided

Estudio Bohora offers:

  • Pre-Designed Templates: Ready-to-use website templates available for purchase.

  • Custom Web Design Services: Personalized design solutions tailored to the client’s specific business needs.

Each service is subject to the policies and conditions outlined in this agreement.

2. Payments

  • Pre-Designed Templates: Payment must be made in full at the time of purchase. All sales are final and non-refundable.

  • Custom Web Design Projects: A non-refundable deposit of fifty percent (50%) is required upon signing the contract. The remaining balance is due upon project completion and before the delivery of final files.

3. Cancellations

  • Custom Projects:

    • The initial deposit is non-refundable.

    • Any additional payments made beyond the deposit will be refunded, minus costs incurred, calculated at $75 per hour of completed work.

    • No refunds will be issued after project delivery.

  • Pre-Designed Templates:

    • All purchases are final. No refunds, cancellations, or exchanges will be provided once digital files have been delivered.

4. Revisions

  • Custom Projects: Include up to two (2) rounds of revisions. Additional revisions will incur extra fees, agreed upon in advance.

  • Pre-Designed Templates: Provided “as is.” Modifications are considered a separate service.

5. Turnaround & Delivery

  • Pre-Designed Templates: Delivered within 24 hours of purchase (or instantly if automated download is available).

  • Custom Projects: Timelines are agreed upon in the project contract, typically ranging from four (4) to six (6) weeks. Delays in client deliverables (content, approvals, or feedback) may extend delivery. Estudio Bohora is not responsible for delays caused by the client.

6. Client Responsibilities

The client agrees to:

  • Provide all required content (text, images, brand assets) by agreed deadlines.

  • Review and approve deliverables in a timely manner.

  • Maintain communication throughout the project.

Failure to meet these responsibilities may result in delays, additional charges, or cancellation as described in the Non-Response Policy.

7. Client Non-Response

If the client fails to respond to communication for two (2) consecutive weeks:

  • Estudio Bohora will issue up to three (3) reminders via email.

  • If no response is received after the third notice, Estudio Bohora reserves the right to cancel the project. Payments already made will not be refunded.

  • To resume the project, the client must settle the full remaining balance, and resumption will be at Estudio Bohora’s discretion.

8. Intellectual Property

  • Pre-Designed Templates: Clients receive a non-exclusive license to use the purchased template. Redistribution, resale, or sharing of template files is strictly prohibited.

  • Custom Projects: Final deliverables become the property of the client once the full balance has been paid. Estudio Bohora retains the right to showcase completed projects in its portfolio and marketing materials.

9. Limitation of Liability

Estudio Bohora is not liable for:

  • Any indirect, incidental, or consequential damages resulting from the use of its products or services.

  • Issues arising from third-party platforms (e.g., Squarespace, hosting providers, payment processors).

  • Losses due to misuse or mismanagement of delivered files by the client.

10. Force Majeure

Neither party shall be held responsible for delays or inability to perform obligations due to circumstances beyond reasonable control (e.g., natural disasters, power outages, illness, government restrictions). Adjustments to deadlines or terms will be evaluated fairly under such circumstances.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Puerto Rico, without regard to conflict-of-law principles.

12. Updates to Terms

Estudio Bohora reserves the right to update or modify these Terms and Conditions at any time. Updates will be posted on our website and will take effect immediately upon posting.
